Pocard

For the ones far away.

Draft. These terms are not in effect yet and are still being reviewed.

Terms

Last updated [EFFECTIVE DATE]

1. These terms

These terms are an agreement between you and [REGISTERED BUSINESS NAME] ("we"), which runs Pocard: the iPhone app and the pages at pocard.app. By using Pocard you agree to them. Our privacy notice explains what we do with your information.

2. Who can use Pocard

You must be at least [13] years old. If you are under 18, you need a parent or guardian's permission. You do not need an account to open a card someone sent you.

3. Your account

4. Your cards

Your photos, words, drawings and voice notes stay yours. To deliver them, you give us permission to store, copy, resize, check and show each card to anyone who opens its link, including making the preview image that chat apps show. This permission is worldwide and free, it is only for running Pocard, and it lasts as long as the card is kept.

Send only photos and recordings you have the right to share, and think about the people in them before you do.

Anyone who has a card's link can open it and read the back, so share the link only with the person it is for. Once you send a card, the person who gets it can keep it, take screenshots of it or forward the link. We cannot take back what they have already seen.

6. What is not allowed

Do not use Pocard to send or share:

Do not try to guess card links, get around our limits or checks, or disrupt Pocard in any way.

7. How we keep Pocard safe

Every image is checked automatically before a card can be opened, and anyone can report a card from its page. We can hide a card, or suspend or close an account, if we believe it breaks these terms or the law, and we may tell the authorities. Automatic checks can be wrong: if we hid something by mistake, email [SUPPORT EMAIL] and we will look at it again.

8. Cards you receive

Cards you keep stay in your album for as long as Pocard runs. If we ever decide to close Pocard, we will tell you at least [60] days ahead and give you a way to save your cards.

9. Price

Pocard is free to use today. If we add paid features, they will be sold through the App Store and come with their own terms, and we will tell you before anything you use stops being free.

10. The iPhone app

The iPhone app is also covered by Apple's standard Licensed Application End User License Agreement. These terms are between you and us, not Apple, and Apple is not responsible for Pocard or for supporting it.

11. No guarantees

We work hard to keep Pocard running and your cards safe, but we provide it "as is". We cannot promise it will always be available or free of errors. Please keep your own copies of photos that matter to you.

12. Limits on our responsibility

As far as Philippine law allows, we are not responsible for indirect or unforeseeable losses, or for what other people do with a card link you shared. [DECISION, with a lawyer: any cap on our total responsibility.] Nothing in these terms takes away rights you have by law as a consumer.

13. Changes, and leaving

We may update these terms. If a change matters, we will tell you in the app before it takes effect; using Pocard after that means you accept the new terms. You can stop using Pocard at any time and ask us to delete your account, as the privacy notice explains.

14. Law

These terms are governed by the laws of the Philippines. Disputes go to the courts of [CITY], unless the law lets you bring them where you live.
